Competition terms and conditions

1. By entering the Promotion entrants agree to be bound by these terms.

2. Entry is open to people aged 14 years old and under on the last day of the Promotional Period.

3. To enter the Promotion, the eligible person must take the survey online, provide their email in the denoted field and, agree to the terms and conditions of the Promotion during the Promotional Period.

4. The Promotion runs from 12:01 am, Friday 26th June to 11:59 pm, Thursday 30th July 2026 (‘Promotional Period’).

5. The Promotion is limited to one entry per person. Any duplicate entries will be removed from the draw.

6. BOPRC reserves the right, at any time, to verify the validity of entries and entrant eligibility and to disqualify any entrant who submits an entry that is not in accordance with these terms or who tampers with the entry process.

7. Entries which include partial information, or are submitted by fraudulent means, are invalid.

8. The promoter is Bay of Plenty Regional Council, 5 Quay Street, Whakatane, PO Box 364, Whakatāne (‘BOPRC’). BOPRC employees, councillors and their immediate family members are not able to enter the Promotion.

9. There are 27 prizes to be won. An entrant may only win one prize. These will be drawn at the end of the promotional period.

10. The Prize draw will take place at 12:00 pm, Bay of Plenty Regional Council Regional House on the first working day of August. The winners of each draw will be drawn at random from all eligible entries received during the Promotional Period, following which the winners will be contacted via email to arrange delivery of the Prize.

11. If the winner does not wish to accept the Prize or if contact is not able to be made with the winner within 5 working days of the Prize draw, the winner will be deemed to have forfeited the Prize and a new winner will be drawn by BOPRC.

12. The winner will be emailed their gift voucher.

13. If any advertised Prize (or part of the Prize) is unavailable, BOPRC, in its discretion, reserves the right to substitute the Prize (or that part of the Prize) with a prize to the equal or greater value and/or specification. The Prize is not transferable, exchangeable or redeemable for cash.

14. The Prizes are subject to terms of use of the companies supplying the Prizes.

15. Any expenses (including but not limited to travel, accommodation, food and beverage) incurred in relation to accepting or using the Prize is the responsibility of the winner.

16. Where the Promotion is made available on a social media platform e.g. Instagram or Facebook, the Promotion is in no way sponsored, endorsed, administered by, or associated with the social media platform. The entrant provides their information to the Promoter and not to the social media platform provider. The entrant completely releases the relevant social media platform provider from any liability in relation to the Promotion.

17. To the extent permitted by law, BOPRC and its associated agencies are not liable in any way (including, without limitation, in negligence) for any loss, damage or injury (including indirect and consequential loss) suffered or sustained in connection with participation in this Promotion or the use of the Prize.

18. Nothing in these terms is intended to exclude, restrict or modify a consumer's rights under the Consumer Guarantees Act 1993.

19. BOPRC, in its sole discretion, reserves the right to cancel or modify the Promotion or any part of it if fraud, technical failures or any other factor beyond BOPRC's reasonable control adversely affects BOPRC's ability to conduct the Promotion or part of it as contemplated in these terms. Any cancellation or modification to the Promotion will be notified on BOPRC's website at BOPRC.govt.nz.

20. BOPRC takes no responsibility for lost, damaged, misdirected, late, illegible or incomplete registrations or entries, incorrect or inaccurate transcription of entry information, or for any human error, technical malfunctions, lost/delayed data transmission, omission, interruption, deletion, defect, line failures, failures of computer equipment or software, inability to access telecommunications network services, corruption of any format holding an entry, failure of the winner to collect the Prize or any other error or malfunction.

21. BOPRC’s decisions on all matters relating to this promotion are final and no correspondence will be entered into.

22. BOPRC receives and holds personal information in accordance with its Privacy Statement which can be found at boprc.govt.nz/privacy-statement. All personal information provided by entrants will be held by BOPRC and will be used to conduct the Promotion in accordance with these terms. Under the Privacy Act 2020 entrants have the right to access and correct their personal information.

Bay of Plenty Regional Council Payble Promotion (the “Promotion”)

Terms and Conditions

1. These terms and conditions (“Terms”) apply to the Promotion. 
2. The promoter is Bay of Plenty Regional Council, 5 Quay Street, Whakatane, PO Box 364, Whakatāne (“BOPRC”, “we” or “us”).
3. The Promotion runs from 12.00am, Monday, 20 July 2026 to 11.59pm, Tuesday, 20 October 2026 (“Promotion Period”).
4. The Promotion is open to Eligible Entries only.  An “Eligible Entry” is a duly completed Payble online payment authority (“Payble”) submitted here, and which is:
   1. in respect of an Eligible Property;
   2. received by BOPRC during the period 27 January 2026 to 20 October 2026; and
   3. not withdrawn or cancelled as at the Draw Date.
5. For the purposes of the Promotion, an “Eligible Property” means a property:
   1. for which rates are payable to the Bay of Plenty Regional Council;
   2. for which the ratepayer(s) is a private individual(s) (i.e.  businesses, companies, central and local government entities, organisations, and other agencies are not eligible for the Promotion);
   3. that is used exclusively for residential/lifestyle purposes; and
   4. for which a BOPRC councillor or employee is not a ratepayer (either solely or jointly with another person(s)).
6. The Promotion is limited to one entry per Eligible Property.
7. BOPRC will automatically enter an Eligible Entry into the Promotion, unless we receive notification from a ratepayer of the relevant Eligible Property that he or she does not wish to participate in the Promotion.
8. All ratepayers of the Eligible Property specified in an Eligible Entry will be deemed to accept and agree to be bound by these Terms (except where a ratepayer has opted out of the Promotion in accordance with clause 7 of these Terms).
9. There are five (5) prizes in total to be won for this Promotion and each winner of a prize (a “Prize Winner”) will receive a Prezzy Card valued at $100 (“Prize”).  If the Prize (or part of the Prize) is unavailable, BOPRC, in its discretion, reserves the right to substitute the Prize (or that part of the Prize) with a prize to the equal or greater value and/or specification. The Prize is non-exchangeable, non-refundable, non-transferable, non-negotiable and cannot be redeemed for cash.
10. The Prize Winners will be determined by a random draw by BOPRC from all Eligible Entries on Monday, 26 October 2026 (“Draw Date”).  A Prize Winner will be the person that is the ratepayer (as determined by BOPRC’s rating records) of the Eligible Property specified in an Eligible Entry that is drawn at random.   Where there is more than one ratepayer of an Eligible Property specified in a winning Eligible Entry, the ratepayers will be named joint winners of the Prize.
11. The Prize Winners will be contacted via phone or email within two (2) business of the Draw Date to arrange delivery of the Prizes.  If, for any reason, a Prize Winner does not wish to accept their Prize or if contact is not able to be made with a Prize winner within five (5) business days of the Draw Date, that Prize Winner will be deemed to have forfeited their Prize and a new winner will be selected by random draw by BOPRC.
12. BOPRC reserves the right to request that a Prize Winner provides proof of identity and/or proof of residency at the nominated prize delivery address.  If such proof is not provided by a Prize Winner to BOPRC within a reasonable time, or is not satisfactory to BOPRC, then that Prize Winner shall forfeit their rights to the Prize.
13. All costs associated with redeeming the Prizes, and all other costs and expenses associated with the Prizes, will be the responsibility of the Prize Winners.  A Prize Winner is not entitled to any compensation if they are not able to use all or any part of the Prize for whatever reason.
14. The Prizes are subject to the terms and conditions of the company or business supplying the Prizes.
15. All Payble payment plans registered in the Payble payment platform are subject to BOPRC’s direct debit terms and conditions.
16. To the extent permitted by law, BOPRC and its associated agencies will not be liable (including, without limitation, in negligence) for any loss, claim, cost, expense, liability or injury (including indirect and consequential loss) suffered or sustained by any person or entity in connection with the Promotion or the Prizes.

20. BOPRC will collect, hold and use your personal information in accordance with the Privacy Act 2020, and its Privacy Statement (or available in hard copy on request).  Under the Privacy Act 2020 you have the right to request access to and correction of your personal information.
21. The Prize Winners grant BOPRC the right to use their image, likeness, and name for marketing and publicity purposes in connection with this Promotion on BOPRC’s website and/or social media networks, and in communications.
22. The Promotion is bound by the laws of New Zealand and any disputes will be subject to the exclusive jurisdiction of the courts of New Zealand.
